Terms of Service

1. Acceptance of Terms

By accessing our website at atg-consultingservices.com or engaging with any of our services, you confirm that you are at least 18 years of age, have read and understood these Terms of Service, and agree to be legally bound by them. If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

2. Services Provided

ATG Consulting Services offers a broad range of professional services including but not limited to:

• Business, HR & Operational Support
• Websites & Online Infrastructure
• Search Visibility & Google Services
• Automation & AI Solutions
• Branding & Creative Services
• Company Photography & Videography

The specific scope, deliverables, timeline, and fees for any engagement will be outlined in a separate Service Agreement or Statement of Work signed by both parties prior to commencement.

3. Client Responsibilities

To enable us to deliver services effectively, you agree to:

• Provide accurate, complete, and timely information, materials, and approvals as required.
• Designate a primary contact person who has the authority to make decisions on your behalf.
• Notify us promptly of any changes that may affect the project scope or timeline.
• Respect agreed-upon timelines for feedback and approval cycles.
• Ensure that any materials you supply do not infringe upon the intellectual property rights of any third party.

4. Payment Terms

Fees for services are outlined in individual proposals or service agreements. Unless otherwise agreed in writing:

• A deposit of 50% of the total project fee is required before work commences.
• The remaining balance is due upon project completion or as per the milestone schedule agreed.
• Invoices are payable within 14 days of the invoice date.
• Late payments may be subject to a late fee of 2% per month on the outstanding balance.
• All fees are exclusive of applicable taxes unless stated otherwise.

5. Intellectual Property

Upon receipt of full payment, ATG Consulting Services assigns to the client all rights, title, and interest in the final deliverables specifically created for the client under the applicable service agreement, except as noted below:

• ATG Consulting Services retains ownership of all tools, frameworks, methodologies, templates, and pre-existing intellectual property used during the provision of services.
• Any third-party assets (stock photography, fonts, software) are subject to their respective license agreements.
• ATG Consulting Services reserves the right to display completed work in our portfolio, marketing materials, and case studies unless you request otherwise in writing.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of our engagement. This obligation survives the termination of any service agreement and continues for a period of two (2) years thereafter. Confidential information does not include information that is publicly available, independently developed, or required to be disclosed by law.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ATG Consulting Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with our services. Our total liability for any claim arising from a service engagement shall not exceed the total fees paid by you for the specific service giving rise to the claim in the three (3) months preceding the event.

8. Termination

Either party may terminate a service agreement by providing written notice. Upon termination:

• You will be invoiced for all work completed up to the termination date.
• Any deposit paid is non-refundable unless ATG Consulting Services is at fault.
• ATG Consulting Services will deliver all completed work product to you upon receipt of outstanding payment.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from these terms or the services provided shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be referred to mediation or arbitration before any legal proceedings are commenced.

10. Changes to These Terms

ATG Consulting Services reserves the right to update or modify these Terms of Service at any time. We will notify existing clients of material changes via email. Your continued use of our services following such notification constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
